By using our application and sensor, you agree to the following terms of use:
The sensor is made by Movesense and we sell it without any modifications and provide you our software service. You should read about the technology and sensor specifications at www.movesense.com/. You are aware that we sell the sensor for business use only and as such there is no warranty for the sensor as per the manufacturer's policy. Our service is a Software as a Service (SaaS) model, and as such, you will be charged a recurring monthly or yearly subscription fee. You understand and agree that our service is provided "as is" and that we make no representations or warranties of any kind, express or implied, as to the operation of the service or the information, content, materials, or products included on the service. You authorize us and Apple to automatically charge your payment method on file for these subscription fees, unless you cancel your subscription before the next billing cycle. Our products are not a consumer produsct and as such, any claims applicable to consumer products do not apply.
You are responsible for ensuring that you are familiar with all of the information provided by Movesense at their own website and that the sensor is used in accordance with the information and in accordance to all applicable laws and regulations. You will not use the application or sensor for any illegal or unauthorized purpose and will not interfere with or disrupt the service or servers or networks connected to the service. You will not use the application or sensor to harm, threaten, or harass any person or entity and will not use it to collect or store personal information of others without their consent. You will not use the application or sensor to share or distribute malware or other harmful software.
You understand and accept that the use of our product and service is at your own risk and we are not liable for any injuries to the user or to a customer of the user or any other third party that may result from the use of our product and service. You understand and accept that we are not liable for any physical, financial, material or any other kind of damages that may occur as a result of the use of our product and service. You agree to indemnify and hold us harmless from any claims, damages, and expenses, including reasonable attorneys' fees, arising from your use of our product and service or from any violation of these terms and conditions by you.
Our product and service is made for general use, and as a user of our product and service you understand and acknowledge that we make no claims or promises about its health-related benefits. As a non-consumer product, the prices shown on our website do not include value-added tax. Our product will dispatch orders as soon as possible, however, we may not always have the product in hand and we may need to order a new batch which may cause a delay in dispatching the product to you. The delivery time may vary depending on availability and the location of delivery. We will make every effort to dispatch your order as soon as possible, but we will not be held liable for any delays in delivery or non-delivery of the product or service. We reserve the right to review and approve all orders for our product and service and may, at our discretion, choose not to proceed with an order. In such cases, any payments made will be fully refunded.
